GENERAL TERMS AND CONDITIONS FOR BIKE RENTAL
These are the general conditions for renting bicycles at BIKE THE WAY, hereinafter MALLORCA FUN TEAM SL, Cif B56199862.
The equipment must be collected and returned by the client at a location located in Camp de s'Oca N°13 bajo 07100 Soller, Balearic Islands, Spain. Unless otherwise agreed with MALLORCA FUN TEAM SL and confirmed in the client’s reservation. The duration of this rental is detailed in the client’s reservation. The term "equipment" in this contract refers to the rented object and accessories.
Return of equipment must be made on or before the "Rental End Date and Time" detailed in the reservation. If the client does not return the equipment on time, a fine of €20.00 per hour will be charged, and if the equipment is returned 5 hours later, the client will be charged at double the published daily rental rate for each day.
The bicycle rental service is aimed at people of legal age, although minors between the ages of 16 and 18 may enjoy the service with the express and responsible authorization of one of their parents or legal guardians. As for those under 16 years of age, they must always be supervised by a responsible adult.
All bikes come with a spare tube, levers, multi-tool, tube repair kit and a pump. We do not charge for the use of the tube in case of a puncture. Any other items, such as a multi-tool, tire levers or pump, not returned will be charged €20.00 per item.
The client declares that he/she has checked the condition of the equipment and found it in perfect condition when signing this document.
The rented equipment must be returned by the client to MALLORCA FUN TEAM SL in the same condition in which it was delivered to the Client, with the exception of dirt from daily and normal use. In case of breakage or total or partial damage to the equipment at the time of return, the client must pay the price corresponding to the refurbish or repair of the equipment at the discretion of MALLORCA FUN TEAM SL.
Clients can request a special service "Partial damage coverage" in their contract, with a rate agreed upon and offered by MALLORCA FUN TEAM SL in each reservation.
The client must take care of the rented equipment and take all necessary precautions to protect the equipment and accessories from damage, loss or theft. In the event that any of the situations mentioned above take place during the rental period, the client assumes all repair or replacement costs that correspond to the price considered by MALLORCA FUN TEAM SL.
At the end of the rental period, MALLORCA FUN TEAM SL will determine the conditions of the rented equipment and, if necessary, will evaluate the losses or damages caused (excluding reasonable wear or dirt from use) and the expenses for damages, losses will be debited from the credit card placed as guarantee.
The client must take care of the equipment during the rental. If the client deems necessary, the client can request a lock but without prejudice thereof, the client must never lose control of the rented equipment.
The client declares to be in perfect health conditions, be able to have the necessary control of the rented equipment and declares to have the traveler and/or health insurance necessary to carry out cycling activities in Mallorca.
The client who rents more than one bicycle, declares that all the cyclists who will use the bicycles rented by the client are in perfect health conditions, are able to have the necessary control of the rented equipment and have the traveler and/or health insurance necessary to carry out cycling activities in Mallorca.
The rental does not include insurance for personal and/or third-party injuries, therefore the client is responsible for all material or personal injuries the client may incur in or undergo.
Once the client rents and makes full or partial payment, this payment will be deemed as the client's acceptance of the Terms and Conditions.
The client and his or her companions declare that they have read and understood the terms and conditions of MALLORCA FUN TEAM SL.
The data provided by the client will be used exclusively for the correct provision of the contracted service, being the client able, in accordance with the law, access, rectification, cancellation or opposition thereof, notifying MALLORCA FUN TEAM SL by any means.
This contract is governed by the Spanish Law.
